Selling a property in Spain

Could anyone share their experience of selling their property? ……….how did the process go?


As far as I am aware the main costs are:

Estate agents – Generally they all charge the same i.e 5,000 euros + 21%VAT (multi-agency)possibly less for sole agency.

Capital gains tax (various grades)…….presumably not applicable if selling at a loss

Plusvalia (local land tax)………..again not applicable if selling at a loss (Constitutional court ruling 16th Feb 2017)

Non-residents & CGT taxes……….3% retention on completion, to tax office. Pay within 30 days, or apply for a refund

Buyer’s deposit……….. 10%. They lose this if they pull out. If the seller pulls out they lose 10% + further 10% compensation

Conveyancing……… Most of work is done by buyer and their solicitor. The only requirement from the seller is to attend the notary (with translator) to close the deal and amend the title deeds.

Documents to be provided by seller……….Title deeds, receipt for SUMA, copies of utility bills, habitation certificate, community statutes & fees receipt, NIE, home energy efficiency certificate, and list of furniture etc , included in sale

I would be interested to know if any sellers used an independent solicitor or conveyancer. If any seller used the services of the selling estate agent for the whole process, going to the notary etc……was there any conflict of interest with the buyer?
