Holiday booking in spain

I booked two holiday with vivella travel one was 29 March for four days, they cancelled that and said they were putting the money back in my bank, which they didn’t do. the other one was 16 May for 8 days and they sent me an e mail saying it was being cancelled and said they could not pay it back as they can’t afford to do so but if I come to the office in September they will give me a voucher for another holiday the total was over 900 euros. Can they do this I thought they had to pay out if they cancelled it. They said they can’t send the voucher by e mail as it has to be signed can they do this it does not seem fair to me.

I don’t think the Association of British Travel Agents’ powers stretch as far as Torrevieja

Clearly you're entitled to your money back and 'not being able to afford it' is not a valid excuse for not giving it back but I fear they may only be telling you the truth and possibly be on the brink of collapse and if that happens in unfortunately you'll get nothing.

Accepting a voucher won't guarantee that it will be honoured but may be the only chance you have of salvaging anything at all.

Not an enviable position for either party.

A lot of UK Agents and Operators are in the same boat. They are awaiting monies back from hotels, resorts, airlines, cruise lines etc. and without that money, they’re finding it impossible to refund customers

We’ve booked a cruise through Vivalia, ar the moment it’s still showing as sailing, on May 7th, I know it’s just a waiting game, but surely the money paid to a travel agent would be with the hotel? Or in our case cruise company? Even if our cruise sails, which I very much doubt, I won’t be on it!

For the airlines with essentially no income stream then legally entitled to refunds or not they simply won't have the cashflow to do it so it will be vouchers or very possibly nothing.

Check it out for yourselves but I heard that RA are doing this already.

I think we can safely say that for the forseeable future at least we've kissed goodbye to €10 airfares!

I think it's the same with everyone we are waiting for a refund from Emirates we should have been seeing our children in Australia, we have had no refund and they have stopped replying so we're going to claim through our travel insurance. Sad times for all
