Completion of Residents Tax Return
Completion of Residents Tax Return
by glosman » Mon May 30, 2016 7:46 pm
Hi hope someone can help & apologies sure this question has been asked loads of times already but can't find replies in 'search'.
We have to complete our first residents Tax Return this month & it is becoming a bit of a struggle finding out what information/documentation/evidence etc is needed. Can anyone recommend an English speaking (I am learning Spanish but English is far easier) fiscal advisor locally that does face to face meetings that could help completion & submission of said return?? Also any ideas on costs would be helpful. Many thanks

I do my own tax returns online now, quite easy really. However our very first one was done by Fernando of PSI Consultants, http://www.psiconsultants.es/, near La Zenia boulevard.
You do not need any documentation as such because the tax return is done on trust, however in the unlikely event that your return is singled out for further inspection it is a good idea to be able to prove your figures.
You will be taxed on all your worldwide income although some types of income are only taxed in UK, some are taxed in both UK and Spain with any tax paid in UK taken into account, and some types of income like UK state pensions, bank interest in both countries and dividend receipts in both countries.
We were charged ISTR 50€ for a single return and 75€ for a joint return.

We can recommend the one on Benijofa, near the cobbled area just above the phamacia. The lady there speaks English and did not charge us as we where not liable to pay tax. Unlike one ones we have been to over the last five years. Wish we had of found her earlier.

Can someone confirm my tax situation as a non - property owner resident in Spain and no earned income in Spain i.e. all pensions paid in UK. A bar room lawyer has informed me (lots of them around) that I am not liable for Spanish tax.

Depends on what your pensions are. If you live in Spain and it is your habitual residence (regardless of whether you own property or not), then you should at least complete the tax return in your first year to get on the system. If you have government service pensions then, from this year, you should declare but will not be liable to tax on them in Spain but they will be taken into account when assessing your level of tax. If you have a state pension (paid without tax taken in UK) then you should declare that and they will add it to the government pensions to work out your tax rate.
The only time you don't need to complete a tax return (after the first year) is if you only have one source of income and it is less than (I think) 22,000 euro a year. But if you have a pension and savings interest then you will need to complete a return.

If you are resident for more than 6 months of the year (183 days or so) then you complete a tax return in May next year (has to be in by end of June) for the previous year. If you have just become a resident (in the last couple of days) then you won't be a fiscal resident this year and your first return will be in May 2017 for income in 2016.
However, if by "just" you mean before July 1st then you will be liable in May 2016 for income in 2015.
Note the tax year in Spain is the same as the calendar year, Jan to Dec.
